1. Definitions
"We", "Us", "Our" refers to My Wix Designer / Ryan Eccleston Creative Ltd.
"You", "Your", "Client" refers to the individual or business engaging our services.
"Project" refers to the website design, branding, or digital services agreed upon.
"Deliverables" refers to the final outputs produced as part of the project.
"Working Days" refers to Monday to Friday, excluding UK bank holidays.
2. Scope of Work
2.1 What's Included
The scope of each project is defined in the proposal or statement of work provided prior to commencement. This document outlines all deliverables, timelines, and exclusions. Work outside this scope is not included unless agreed in writing and may incur additional charges.
2.2 Scope Changes & Additional Work
Should you require work beyond the original scope (including but not limited to additional pages, features, functionality, or design revisions beyond those specified), we will provide a written quote for the additional work before proceeding. This ensures full transparency and prevents misunderstandings.
2.3 Third-Party Integrations
Where third-party tools, platforms, or services are required (e.g., booking systems, payment gateways, CRM integrations), their functionality is subject to the capabilities and limitations of those providers. We are not responsible for changes, outages, or limitations imposed by third-party platforms.
3. Payment Terms
3.1 Deposit
A deposit of 50% is required to secure your project slot and commence work. All deposit payments are strictly non-refundable under any circumstances. The deposit covers the reservation of your project slot in our schedule, initial project setup, discovery work, and the commitment of resources to your project. No work will begin until the deposit has been received and cleared.
3.2 Balance Payment
The remaining 50% balance is due upon project completion, prior to the website going live or final files being transferred to your ownership. "Completion" is defined as the point at which all deliverables outlined in the proposal have been provided and the site is ready for launch.
3.3 Payment Methods
We accept payment via bank transfer (BACS) and credit/debit card. All invoices are payable within 14 days of issue unless otherwise agreed.
3.4 Late Payment
Invoices not paid within the agreed timeframe will incur a late payment fee of 8% above the Bank of England base rate, in accordance with UK Late Payment of Commercial Debts legislation. We reserve the right to suspend services or withhold deliverables until outstanding balances are settled.
4. Project Timelines & Client Responsibilities
4.1 Estimated Timelines
Timelines provided are estimates based on typical project flows. Actual delivery depends on timely provision of content, feedback, and approvals from your side.
4.2 Client-Caused Delays
We require your cooperation to deliver projects on time. Delays caused by late content, slow feedback, or prolonged approval cycles may extend the project timeline. If a project is delayed by more than 30 days due to client non-responsiveness, we reserve the right to invoice the remaining balance and close the project. Restarting work would then be subject to availability and may incur additional charges.
4.3 Content Provision
You are responsible for providing all content (text, images, videos, credentials, brand assets) required for the project. If you are unable to supply professional imagery, we can source stock photography at an additional cost. Content must be provided in the formats requested within agreed timeframes.
5. Revisions & Amendments
5.1 Included Revisions
Each project phase includes a reasonable number of revision rounds as specified in your proposal (typically 2 rounds per deliverable). Revisions refer to minor adjustments and refinements, not fundamental changes to the agreed design direction.
5.2 Additional Revisions
Revision requests that exceed the included allocation, involve significant changes to previously approved work, or alter the fundamental design direction will be quoted separately and charged at our standard hourly rate.
5.3 Feedback Format
To avoid miscommunication, we request that feedback be consolidated and provided in writing (via email or annotated document). Verbal feedback provided outside of scheduled calls may not be actioned if not confirmed in writing.
6. Design Approval & Sign-Off
6.1 Approval Process
At key milestones, we will present work for your review and approval. Once approved, that phase is considered complete. Subsequent changes to approved work will be treated as additional revisions and quoted accordingly.
6.2 Deemed Approval
If no feedback is received within 7 working days of presenting work for review, that work will be deemed approved, and we will proceed to the next phase.
7. Website Hosting & Ownership
7.1 Wix Platform & Independence
My Wix Designer is an independent web design agency and is in no way affiliated with, endorsed by, or directly associated with Wix.com Ltd. "My Wix Designer" is simply a trading name reflecting our specialism in building websites on the Wix platform.
Websites built on Wix are hosted on Wix's platform. You will need to maintain a Wix Premium Plan to keep your website live. We can advise on the appropriate plan but are not responsible for ongoing hosting costs.
7.2 Platform Updates & Outages
Wix, like all software platforms, periodically releases updates that may affect the appearance or functionality of your website. We are not responsible for disruption, outages, or issues caused by platform updates, changes to Wix's terms of service, or Wix infrastructure problems. In the event that a platform update adversely affects your site, we will endeavour to assist where possible, however this is at our discretion and any remedial work may be billable at our standard rates.
7.3 Site Transfer
Upon final payment, ownership of your website will be transferred to your Wix account. Prior to this, the site remains in our account. We do not release site ownership or access until all outstanding invoices are paid in full.
7.4 Domain Management
Domain registration and DNS management remain your responsibility unless explicitly included in the project scope. We can provide guidance on domain configuration.
8. Search Engine Optimisation (SEO)
8.1 SEO Fundamentals
All websites we build are optimised with on-page SEO fundamentals, including proper heading structure, meta titles and descriptions, alt text for images, clean URL structure, and mobile responsiveness. We also submit your site to search engines and ensure it is indexed.
8.2 SEO Expectations — Please Read Carefully
Implementing SEO fundamentals will not get you to number one on Google. The foundational SEO work we include is exactly that — a foundation. It ensures your website is technically sound and search-engine friendly, but it is merely the starting point upon which more strategic, ongoing SEO work must be built to achieve meaningful rankings.
Ranking competitively in search engines requires sustained effort over time, including content strategy, backlink acquisition, local SEO, keyword research, and ongoing optimisation. This level of work is not included in standard website projects and would need to be quoted separately as an ongoing service.
We do not guarantee specific search rankings, traffic volumes, or timelines for results. Any agency that promises guaranteed rankings should be treated with caution — Google's algorithms are complex, ever-changing, and not something any agency can control.
9. Print & Stationery Deliverables
9.1 Digital Files
Stationery designs (business cards, letterheads, compliment slips, etc.) are provided as print-ready PDF files suitable for professional printing.
9.2 Word Document Letterheads
Where letterheads are provided as Word documents for in-office printing, please note that print output can vary significantly depending on your printer settings, printer model, paper type, and software version. We provide templates optimised for standard settings, but cannot guarantee identical output across all systems. If you experience printing issues, we recommend having letterheads professionally pre-printed and printing your content onto those.
9.3 Print Responsibility
We are not responsible for the final print quality produced by third-party printers. We recommend ordering a proof before committing to large print runs.
10. Post-Launch Support
10.1 Support Period
Following launch, we provide 30 days of complimentary support for minor queries and issues related to the work delivered. This does not include new development work, major changes, or issues caused by third-party modifications.
10.2 Ongoing Support
After the initial support period, we offer ongoing support and maintenance packages. Details of our support options can be found at: https://www.mywixdesigner.com/support-options. Any work requested outside of an active support agreement will be quoted separately.
11. Intellectual Property & Copyright
11.1 Transfer of Ownership
Upon receipt of final payment, you will own the completed website design and any custom graphics created specifically for your project. Raw design files (e.g., source Figma/Illustrator files) remain our property unless otherwise agreed.
11.2 Third-Party Assets
Stock images, fonts, and other third-party assets are subject to their respective licence agreements. We will advise on any licensing requirements.
11.3 Portfolio Rights
We reserve the right to display completed work in our portfolio, case studies, and marketing materials unless you request otherwise in writing prior to project commencement.
12. Limitation of Liability
12.1 Service Limitations
While we take every care to deliver high-quality work, we cannot guarantee that our services will be error-free or that specific business outcomes (e.g., sales, leads, rankings) will be achieved.
12.2 Maximum Liability
Our total liability for any claim arising from a project is limited to the total fees paid for that project. We are not liable for indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunities.
12.3 Third-Party Services
We are not liable for issues arising from third-party platforms, hosting providers, or services integrated into your project, including but not limited to Wix, payment processors, or booking systems.
13. Confidentiality
Both parties agree to keep confidential any proprietary information disclosed during the project. This includes business strategies, customer data, pricing, and any other sensitive information. This obligation survives the termination of the agreement.
14. Termination & Cancellation
14.1 Client Cancellation
If you wish to cancel a project after the deposit has been paid, the deposit is non-refundable. If work has progressed beyond the deposit value, you will be invoiced for work completed to date at our standard rates.
14.2 Our Right to Terminate
We reserve the right to terminate a project if payment terms are not met, if you become uncontactable for an extended period (30+ days), or if conduct becomes unreasonable or abusive. In such cases, you remain liable for work completed.
14.3 Deliverables on Termination
Upon termination, you will receive any deliverables completed to date, provided all outstanding invoices have been paid.
15. Dispute Resolution
15.1 Good Faith Resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter in good faith through direct communication. If we are unable to replicate or resolve a technical issue, we will work with you to find a fair solution, which may include a partial credit for future work.
15.2 Governing Law
We may update these terms from time to time. The version in effect at the time of your project commencement will apply to that project. We will notify you of any material changes.
16. Amendments to Terms
In the event of a dispute, both parties agree to first attempt to resolve the matter in good faith through direct communication. If we are unable to replicate or resolve a technical issue, we will work with you to find a fair solution, which may include a partial credit for future work.
17. Acceptance
By paying the deposit or signing a proposal, you confirm that you have read, understood, and agree to these Terms & Conditions.
